Humanitarian & Compassionate (H&C) Considerations

For foreign nationals who require an exemption on their permanent residence application

A small number of foreign nationals can acquire permanent resident status via H&C in specific circumstances.

Section 25(1) of the Act allows the Minister of Citizenship and Immigration to grant permanent resident status or a permanent resident visa to a foreign national who may have otherwise been inadmissible or unable to meet the requirements for other permanent residence streams if there exists sufficient humanitarian and compassionate justifications for doing so. Factors that are considered include, but are not limited to:

Best interests of the child
Dealing with family relationships
Statelessness
Degree of hardship
Establishment in Canada

Permanent resident status and exemptions given under H&C only occur in exceptional circumstances and must be truly compelling. A thorough investigation and analysis is done so it is false to assume that H&C considerations can be granted as an alternative means to acquiring permanent resident status.
